Third Party Breach Liability

Chapter: C18

In Simple Terms

If a Power Unit manufacturer's engine secrets are leaked through a third party (like a supplier or contractor), the FIA will consider what steps the manufacturer took to prevent or fix the problem when deciding on penalties. Basically, if you tried your best to stop the leak, you might face lighter consequences than if you did nothing.

  • Third parties (suppliers, contractors, partners) may be involved in LPUC information leaks
  • Manufacturers can reduce liability by taking preventive measures and remedying breaches
  • FIA evaluates manufacturer's efforts when determining penalties for confidential engine data breaches
  • Proactive security measures and damage control are considered in liability assessment
