Limitation Period for Breaches

Chapter: D9

In Simple Terms

F1 has a five-year deadline to charge a team or team member with a cost cap breach. The clock starts from either the end-of-year financial reporting deadline or when the cost cap officials discover hidden violations, whichever comes later. After five years, no charges can be filed.

  • Teams cannot be charged with cost cap violations after 5 years have passed
  • The 5-year period begins from the Full Year Reporting Deadline or when concealed breaches are discovered, whichever is later
  • This is a statute of limitations to provide teams with certainty about potential liability
  • The rule applies to both F1 teams and individual team members
Official FIA Text

No charge may be brought against an F1 Team or Individual F1 Team Member unless notice is given within five years of the later of the Full Year Reporting Deadline or the date the Cost Cap Administration learned of concealed acts or omissions.
