Accepted Breach Agreement (ABA) – Individual F1 Team Member
Chapter: D8
In Simple Terms
If the Cost Cap Administration finds that an individual team member (like an engineer or staff member) has broken cost cap rules, they can offer that person a deal called an Accepted Breach Agreement (ABA) to resolve the issue. Importantly, there's no right to appeal whether the Cost Cap Administration decides to offer this deal or not.
- The Cost Cap Administration has discretion to offer an ABA when an individual team member breaches cost cap obligations
- An ABA is a settlement agreement between the Cost Cap Administration and the individual team member
- There is no appeal process regarding the decision to offer or enter into an ABA
- This applies specifically to individual team members, not teams themselves
Official FIA Text
If the Cost Cap Administration determines that an Individual F1 Team Member has committed a breach of their obligations, the Cost Cap Administration may offer to enter into an ABA with the Individual F1 Team Member. There shall be no right of appeal regarding whether or not to offer or enter into an ABA.
Article D8.11.3
Conditions for ABA Entry
Chapter: D8
In Simple Terms
Before a team member can settle a rule breach with the FIA through an Agreed Breach Agreement (ABA), they must admit to the violation, fully explain what happened, accept whatever punishment is given, pay any associated costs, and give up their right to fight the decision in court or appeal it.
- The team member must openly admit to breaking the rules
- They must provide complete and honest information about the breach
- They must accept the penalties without the ability to appeal or challenge them later
- They are responsible for paying all costs related to the agreement
Official FIA Text
The Cost Cap Administration may only enter into an ABA where the Individual F1 Team Member accepts breach, confirms full disclosure, accepts imposed sanctions, agrees to bear costs, and waives their right to appeal or challenge the ABA.
